TERMS AND CONDITIONS

 

 

1. DEFINITIONS:  ​
For this agreement, the following words shall have the following corresponding meaning:
·    Photo Booth Studio: Photo Booth Studio (ABN: 74337420086)
·    Client: The person, organisation, company, or other body which is hiring the goods/service as specified on the invoice.
2. BOOKING CONFIRMATION
2.1. A booking is not confirmed until the client pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from Photo Booth Studio
 
3. PAYMENTS
3.1. A non-refundable deposit of $200 is payable within 7 days of receiving the invoice. The booking is not confirmed until the deposit is received by Photo Booth Studio.
3.2. The remaining balance will be payable by the client at least 14 days before the booked date, unless otherwise agreed to in writing by both parties.
3.3 If Photo Booth Studio has not received final payment for the booking at least 24 hours before the booked date, Photo Booth Studio will deem that a cancellation on behalf of the client and all monies paid to date will be forfeited, unless both parties have made prior mutually agreed arrangements in writing for a late payment.
 
4. SPACE, ACCESS, POWER & INTERNET REQUIREMENTS 
4.1. The client must ensure:
– a space of 3m x 3m x 2.4m high is available for the photo booth.
– access to 240v power within 10m of the photo booth.
– if an outdoor event, an undercover area with a firm, flat floor surface, not subject to rain or wind with wall protection on at least one side. 
– We utilise the venue’s WIFI for QR code photo downloads and have our own 4G connection if the venue does not have WIFI, however Photo Booth Studio is not responsible if the venue location does not have a strong WIFI or 4G Signal.

 
5. SOCIAL MEDIA & USE OF IMAGES
5.1. The Client accepts responsibility for all photos shared to social media by guests at the event.
5.2. The Client gives permission for all photos taken during the hire to be shared by Photo Booth Studio on our own social media platforms and website and for advertising and promotional purposes, unless the client requests otherwise, in writing, before the date of the event.
5.3. Photo Booth Studio will not use images deemed unsuitable or inappropriate on our website or for advertising and will not use any content that we consider may be personally damaging to any person(s)
5.4 Photos of persons under 18 years of age will not be published on social media platforms.
5.5 Photo Booth Studio will not sell your personal details to any third party and will take all reasonable measures to ensure that your personal details remain confidential.
6. CHANGES & CANCELLATIONS 
6.1. Requests for changes of event date must be made at least 30 days before the original event date. A date change is subject to availability.
6.2. All cancellations will result in the client forfeiting the deposit.
6.3. Cancellations made within 30 days of the event date will result in the client forfeiting all payments made to Photo Booth Studio.
6.4. In the unlikely event Photo Booth Studio must cancel a booking, all payments made to date will be refunded to the client.
7. DAMAGE TO EQUIPMENT/SAFETY PRECAUTIONS
7.1. The Photo Booth Studio attendant may pause or terminate the use of the photo booth at any time during the event if they consider that the guests are behaving in a way that is considered dangerous to themselves or any persons, or potentially damaging to the equipment.
7.2. Any damage to the photo booth equipment during the client’s event caused by the client, client’s guests, or any other person in attendance at the event whether invited or not, will result in the cost to repair/replace the equipment to be invoiced to the client post event. 
7.3. Safety Precautions:
- No food, drinks, cigarettes, or e-cigarettes in the photo booth area
- No chairs or other objects to stand on to be taken into the photo booth.
- Children under the age of 12 are to be supervised by an adult when in the photo booth.
- The attendant reserves the right to withhold or remove all or certain props from use if the attendant considers they are being mistreated or damaged intentionally or unintentionally.
9. INDEMNIFICATION
9.1. Photo Booth Studio will not be held liable for delays or failing to provide service due to the occurrence of any event beyond our reasonable control, including a labour disturbance, natural disaster, or extreme weather event (including but not limited to flooding, fire & storms) which might prevent the photo booth attendant from attending the venue).
9.2. Photo Booth Studio will not be held liable for failure to attend or complete a booked event in the event of closure of the venue prior to or during a booked event or cancellation of a booked event by the venue or by cancellation of a booked event or closure of the venue by other parties or government authorities.
9.3.  Photo Booth Studio will not be held liable if equipment failure or damage (including electrical, water or other liquid damage) is due to any negligence, an act or fault on the part of any client or client guest or other person using the photo booth at the booked event, which negligence, act, or fault, wilfully or accidental in turn prevented the successful completion of the booked service(s).
9.4 At all times care will be taken by Photo Booth Studio to ensure completion of the booked package. However, should unforeseen delays or equipment failure prevent this, during the normal course of events liability will be limited to a total or partial refund of monies paid, dependent of the unique circumstances and/or the amount of the booking that was fulfilled successfully.
